CuddleTales Terms of Use

These terms are an agreement between you and InnerTales Private Limited, a company incorporated in India (address in section 12) ("we", "us"), for using the CuddleTales app. By creating an account you agree to them for yourself and for every child profile you add. Please also read our Privacy Policy, which explains how we look after personal information. If you got the app from the Apple App Store, section 11 also applies.

1. The account

• Only an adult who is the child's parent or legal guardian (or has their permission) may create and hold an account. Children use the app only inside a child profile that the adult creates and supervises.
• Keep your sign-in details private. You are responsible for what happens in your account, including purchases.
• Information you give us must be accurate. Use a first name or nickname for a child, not their full name.

2. Cuddle Plus subscription

• Some content is free. Cuddle Plus unlocks everything and is an auto-renewing subscription bought through the Apple App Store or Google Play. The price and length are shown before you buy, and payment is taken by the store.
• It renews automatically unless you turn off auto-renew at least 24 hours before the current period ends; the renewal is charged within the 24 hours before the period ends.
• Manage or cancel it at any time in your Apple ID or Google Play subscription settings. Deleting the app does not cancel the subscription. Deleting your CuddleTales account cancels a Google Play subscription so it does not renew; an App Store subscription must be cancelled in your Apple ID settings (the app shows you where before you delete).
• Refunds are handled by Apple or Google under their policies. Nothing in these terms takes away any refund or cancellation right you have under the law where you live.
• If a free trial is offered, any unused part ends when you buy a subscription.
• We may change what Plus includes or its price. A price change will not affect a period you have already paid for, and the store will tell you before it applies.

3. Using the app

The app is for personal, non-commercial family use. You agree not to:

• copy, sell, rent, redistribute or publicly perform the app's content;
• try to get around the grown-up check, subscription or device limits, or access the app in a way we have not provided;
• reverse-engineer, interfere with or overload the app or our servers, except where the law allows this;
• use the app in a way that breaks the law or harms anyone.

4. Our content

The stories, songs, characters, artwork, voices and software in the app belong to us or the people we license them from, and are protected by copyright and other laws. We give you a personal, non-exclusive, non-transferable, revocable licence to use them in the app for as long as these terms apply. We work hard to keep everything suitable for young children; if you ever see something that is not, please tell us and we will act quickly.

5. Things your family adds

If you add details about your family (for example, a child's first name), you confirm you are allowed to share them. You keep them; you let us use them only to provide the app to your family, as our Privacy Policy describes.

6. Availability and changes

We are always improving CuddleTales, so features and content may change, and the app may sometimes be unavailable for maintenance or reasons beyond our control. Some features need an internet connection. We will give reasonable notice before removing a major feature that you have paid for.

7. Ending the agreement

You may stop using the app and delete your account at any time in the app (Settings → Account & help → Manage account → Delete account). We may suspend or close an account that seriously or repeatedly breaks these terms, puts a child at risk, or where the law requires; if we do, we will tell you why unless the law prevents it. Sections 4, 8, 9, 10 and 11 continue to apply after the agreement ends.

8. Our responsibility

• We provide the app with reasonable care and skill. Apart from that, and to the extent the law allows, the app is provided "as is", without promises that it will always be available or free of errors.
• To the extent the law allows, we are not responsible for indirect or unforeseeable loss, and our total responsibility to you for any claim is limited to the amount you paid us for CuddleTales in the 12 months before the claim.
• Nothing in these terms limits responsibility that cannot be limited by law, including for death or personal injury caused by negligence, for fraud, or your rights as a consumer under the law where you live.
• The app is for entertainment and early learning together with a grown-up. It is not a substitute for supervision, or for medical, developmental or educational advice.

9. Law and disputes

If something goes wrong, please contact us first: most problems can be solved quickly. These terms are governed by the laws of India, and the courts of Bhubaneswar, Odisha, India have jurisdiction. If you are a consumer living elsewhere, you also keep the protection of the mandatory laws of your country and may bring a claim in your local courts.

10. Other terms

• We may update these terms. We will change the date above and, for important changes, tell you in the app or by email before they apply. If you do not agree to a change, you may delete your account.
• If part of these terms cannot be enforced, the rest still applies. Not enforcing a term right away does not mean we give it up.
• You may not transfer this agreement to someone else. We may transfer it to a business that takes over CuddleTales, without reducing your rights.

11. If you got the app from the Apple App Store

• These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for the app.
• If the app does not meet a warranty that applies to it, you may tell Apple and Apple may refund the price you paid for it. To the extent the law allows, Apple has no other warranty obligation for the app.
• Apple is not responsible for any claim about the app, including product-liability claims, claims that it does not meet a legal or regulatory requirement, consumer-protection claims, or claims that it infringes someone's intellectual property. We are responsible for handling those claims.
• You confirm that you are not in a country under a United States Government embargo and are not on a United States Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you as a third-party beneficiary.
